On January 31, 2013 the regulations for ADA compliancy will be enforced for all public swimming pool and spa facilities. The rules were passed last year and aspects pertaining to Title II and Title III were delayed by the justice department. As of this January 31, 2013 these rules effecting public swimming pool and spa facilities will become enforceable.

“On May 18, 2012, the Department announced that it is adopting a final rule extending the compliance date for sections 242 and 1009 of the 2010 Americans with Disabilities Act (ADA) Standards for Accessible Design, as they relate to the provision of accessible entry and exit to existing swimming pools, wading pools, and spas (pools built before March 15, 2012). These provisions for existing pools of title II and title III entities will now take effect on January 31, 2013. The final rule does not affect the March 15, 2012 effective date for newly constructed or altered pools.”
Most of the rule change went into effect on March 15, 2012 with pending revisions to Title II and Title III for Accessible Design will use 2010 Standards after March 15, 2012. Any changes or upgrades to a facility must use 2010 Standards.
Title II and Title III New Construction after March 15, 2012. Any construction of facilities must use 2010 Standards.
Title III: Readily Achievable Barrier. After March 15, 2012 shall use 2010 Standards.

Failure to follow these rule changes can lead up to a $55,000.00 fine and subsequent fines starting at $110,000.00 . So don’t take a chance.
